Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the MagicSpot website and services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1) Who We Are

MagicSpot connects brands with streamers for authentic, non‑intrusive advertising partnerships. Brands can register via email verification (magic link). Streamers authenticate via Twitch OAuth. The platform enables discovery and registration workflows; campaign and payment features may be rolled out over time.

2) Eligibility

  • You must be at least 16 years old (or older where required by local law).
  • If you act on behalf of a company, you represent that you are authorized to bind that company.

3) Accounts & Authentication

  • Brands: You register using an email magic‑link. You are responsible for the security of your email account and any actions taken via verified access.
  • Streamers: You authenticate using Twitch OAuth. By connecting, you authorize us to receive your Twitch ID, username, and (where available) email.
  • You must provide accurate information and keep it up to date.

4) Acceptable Use

  • No unlawful, infringing, defamatory, hateful, or fraudulent activity.
  • No attempts to access accounts, data, or systems without permission or to interfere with the Service.
  • No use of the platform to facilitate deceptive or unsafe advertising or sponsorships.

5) Brand–Streamer Collaborations

  • MagicSpot facilitates introductions but does not guarantee any match, campaign, or outcome.
  • Streamers retain full discretion to accept or decline any brand partnership.
  • Parties are solely responsible for complying with applicable advertising and platform rules.

6) Payments & Fees

Unless otherwise stated in the interface, payments are not processed through MagicSpot at this time. If and when payment functionality is introduced, we will provide additional terms that will govern such features.

7) Intellectual Property

  • The Services, site design, and underlying software are owned by MagicSpot or its licensors.
  • You retain ownership of your content. You grant us a limited, worldwide, non‑exclusive, royalty‑free license to host, display, and use your submitted materials solely to operate and improve the Services.
  • You represent you have rights to the materials you provide (e.g., logos, names, imagery).

8) Privacy & Data

Our processing of personal data (including email magic‑link verification and Twitch OAuth data) is described in our Privacy Policy. By using the Services, you acknowledge our data practices as outlined there.

9) Third‑Party Services (Twitch)

The Services integrate with Twitch for streamer authentication. Your use of Twitch is subject to Twitch’s terms and policies. We are not responsible for third‑party services.

10) Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant uninterrupted or error‑free operation.

11) Limitation of Liability

To the maximum extent permitted by law, MagicSpot and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Services.

12) Indemnification

You agree to defend, indemnify, and hold harmless MagicSpot from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services or your violation of these Terms.

13) Suspension & Termination

We may suspend or terminate your access if you violate these Terms or if we believe it is necessary to protect the Service, users, or third parties. You may stop using the Services at any time.

14) Changes to the Services and Terms

We may modify the Services and these Terms. Material changes will be posted on this page, and your continued use constitutes acceptance of the updated Terms.

15) Governing Law

These Terms are governed by the laws of Germany, without regard to conflict‑of‑laws principles. Mandatory consumer protection laws of your country of residence remain unaffected.
